Three plead not guilty = in 'thrill=20 kill' shooting

MOUNT VERNON - In a courtroom packed with naval officers in = dress=20 whites, three Anacortes men yesterday pleaded not guilty in the = alleged=20 "thrill kill" shooting of a Navy lieutenant July 28.=20
Seth Anderson, 23, and his half brother Eben Berriault, 36, = entered=20 not-guilty pleas on first-degree-murder charges at their = arraignment in=20 Skagit County Superior Court. Adam Moore, 25, pleaded not guilty = to=20 first-degree manslaughter.=20
Berriault is accused of firing the fatal shotgun blast, while = Anderson=20 reportedly drove the car the three were in during a night of = drinking and=20 random shooting. Moore was a passenger, authorities said.=20
Skagit County Prosecutor Tom Verge said yesterday he would = decide by=20 Aug. 24 whether to charge Berriault and Anderson with aggravated=20 first-degree murder, which carries the possibility of the death = penalty.=20
That could make this the first death-penalty case to be tried = in Skagit=20 County, Verge said.=20
A trial date for the three was initially set for Oct. 2, though = Verge=20 said he doubted the case would be ready to proceed then.=20
If convicted of first-degree murder, Berriault would face 46 to = 58=20 years in prison and Anderson 38 to 48 years in prison. Moore would = face=20 six to nine years on the manslaughter charge.=20

All three have denied involvement in Lt. j.g. Scott Kinkele's = killing.=20 But in court papers, authorities describe events they said = preceded the=20 shooting of Kinkele on a rural stretch of Highway 20 six miles = west of=20 Burlington shortly after midnight July 28. Kinkele, 23, had just = stopped=20 to buy gas.=20

According to the court papers, the three started their day July = 27 with=20 several drinks at a tavern in Anacortes about 2 p.m. and moved on = to=20 another bar for several more drinks.=20
After dinner, the three set out in Anderson's 1980 Pontiac = Firebird a=20 little after 8 p.m. to poach deer, the court papers said. They = headed out=20 with a .22-caliber rifle and a 12-gauge shotgun, authorities said. =
At one point Berriault leaned out of the car and fired the = rifle at a=20 road sign, according to court documents.=20
When they approached the Sedro-Woolley area, Berriault fired = the gun at=20 a dog and laughed when he heard the dog yelp, a court affidavit = said.=20
About 11:15 p.m., Berriault fired the rifle at a car driven by = a=20 33-year-old Sedro-Woolley woman, who was not hurt, prosecutors = said.=20 Berriault has been charged with first-degree assault in that = shooting.=20
When the three saw a police car behind them, Berriault threw = the rifle=20 out the window, according to court papers.=20
Although the three had been drinking heavily, the drinks were = spread=20 throughout the day and they did not appear drunk, according to the = Skagit=20 County sheriff's deputy who pulled them over for speeding. No one = had=20 called police about shots being fired, so the deputy, Dan Luvera, = let them=20 off with a stern warning.=20
Less than half an hour later, the three accelerated toward = Kinkele's=20 car on Highway 20, Berriault leaning out the window with shotgun = in hand,=20 court papers said.=20
Kinkele was shot in the back of the head and died immediately. = Verge=20 described the shooting as a "thrill kill."=20
Kinkele, a San Francisco native, will be buried with full = military=20 honors Wednesday at Arlington National Cemetery outside = Washington, D.C.=20
About a dozen officers who were stationed at Whidbey Island = with=20 Kinkele attended yesterday's arraignment in a show of support for = his=20 family, Navy Lt. David Richman said.=20
"This has been a great loss for the base, to lose a shipmate = like=20 this," Richman said. "We're here today for his family and for = him."
